Terms of Service

1. Agreement to these terms

These Terms (the “Terms”) are a binding agreement between you and Sold Out Collective (“Sold Out Collective,” “we,” “us”) governing your use of the website at scancrew.app and the related application (the “Service”). By using the Service you agree to these Terms and our Privacy Policy. If you don't agree, don't use the Service.

2. Eligibility

You must be at least 18 years old, able to form a binding contract, and legally permitted to do this work. You agree the information you provide — including your identity details and ID — is accurate and yours.

3. What Sold Out Collective is

Sold Out Collective coordinates paid opportunities to attend concerts at NYC venues and collect ticket scans, and lends you a device to do so. Sold Out Collective is not your employer; participation is on a per-show, opportunity-by-opportunity basis, and nothing here creates an employment relationship, partnership, or guarantee of work or earnings. This is not legal or tax advice; you're responsible for your own taxes on amounts you earn.

4. Your account and identity

To be matched and to borrow a device, you must complete a profile and submit a photo of your government-issued ID for verification. Keep your details accurate and your access credentials secure. Approval is at our discretion, and we may decline or revoke it.

5. Devices — your responsibility

Any device we lend you remains Sold Out Collective's property. Before each handoff you accept a device agreement for that loan. By accepting it and taking the device, you agree to:

  • keep the device safe and use it only for the assigned shows;
  • return it at the scheduled drop-off time and place, in the condition you received it; and
  • be responsible for the device while it's in your care.

If you fail to return a device, or return it lost, stolen, or damaged beyond normal use, you may be responsible for its repair or replacement cost, and we may withhold related payouts and pursue recovery. We retain your identity information on file for this reason (see the Privacy Policy).

6. Shows, scheduling, and payment

We may offer you shows based on your availability; you can confirm or decline, and we may reassign or cancel. The payout for each show is shown before you confirm. You earn the payout for a show you complete in accordance with these Terms and return the device for; payouts are made out-of-band (e.g. Venmo, Zelle, or cash) on a reasonable schedule. We may withhold or adjust payment for shows not completed as agreed or where the device isn't returned.

7. Acceptable use

Don't misuse the Service or the device, misrepresent your identity, attempt to access another person's data, interfere with the Service, or use it for anything unlawful. Follow venue rules while attending shows.

8. Suspension and termination

You may stop using the Service at any time. We may suspend or remove your access at our discretion — including for failing to return a device or breaching these Terms. On removal we delete your ID photo as described in the Privacy Policy.

9. Disclaimers

The Service is provided “as is” without warranties of any kind. We don't guarantee that shows, assignments, or earnings will be available, or that the Service will be uninterrupted or error-free. Event data comes from third-party sources and may be inaccurate or change.

10. Limitation of liability

To the maximum extent permitted by law, Sold Out Collective and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or earnings, arising from your use of the Service. Our total liability for any claim is limited to the amounts we paid you in the three months before the claim.

11. Indemnification

You agree to indemnify and hold harmless Sold Out Collective and its operators from claims arising out of your use of the Service or a device, your breach of these Terms, or your violation of any law or third-party right.

12. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located there.

13. Changes

We may update these Terms. We'll revise the “Last updated” date and, for material changes, take reasonable steps to notify you. Continued use means you accept the updated Terms.
